iAnki Terms of Use

  1. iAnki ("Service") is a service offered by Redfox, Inc., ("Redfox").
  2. These Terms of Use ("TOU") apply to any and all actions undertaken when a user uses the Service.
  3. Users shall comply with the TOU when using the Service.
  4. Use of the Service by a user constitutes acceptance of all terms and conditions of the TOU.
  1. Redfox may, at its own discretion, change the TOU at any time and for any reason.
  2. Except in extraordinary circumstances, revised versions of the TOU shall take effect immediately from the time of revision.
  3. If a user uses the Service after a revised version of the TOU takes effect, such use shall constitute acceptance of all the terms and conditions of the revised TOU.

  1. To use the Service, a user must apply for membership by a method prescribed by Redfox after first accepting the terms and conditions of the TOU.
  2. A prospective user who has applied for membership becomes a user of the Service once Redfox has approved their membership.
  1. In any of the following situations, Redfox may, at its own discretion, cancel user registration and prohibit a user from any and all use of the Service.
    • If the Service has not been used for 12 months.
    • If a user is determined to have violated the TOU or other terms of use or other regulations.
    • If it is ascertained that a user has previously had his or her membership cancelled because he or she violated the TOU or other terms of use or other regulations in the past.
    • If a user engages in any action that constitutes an action defined in "9. PROHIBITED ACTIONS".
    • If a user engages in other actions that Redfox judges to be inappropriate.

  1. When applying for membership, users must use an e-mail address that they themselves manage as their registered e-mail address. If the registered e-mail address is not managed by the user, the user must promptly change the registered e-mail address to a separate, usable e-mail address that they manage.
  2. Users shall bear complete liability for managing their registered e-mail address and password.
  3. Except to the extent due to the gross negligence of Redfox, Redfox shall bear no liability whatsoever for damage resulting from use of the registered e-mail address or password by a third party.
  4. The registered e-mail address and password can only be used by the individual, and any and all assignment or lending thereof is prohibited.
  5. Users may have one user account each and may not have multiple accounts, except in extraordinary cases where permitted by Redfox.
  6. When Redfox determines such action to be necessary, it may prohibit use of the Service by deleting the accounts of specific users.
  1. Users use the Service at their own liability and shall bear all liability for actions taken while using the Service and the results of such actions.
  2. The environment, equipment, software, and means of communications required to use the Service shall all be prepared by the user at the user's own liability. Redfox shall in no way be involved with the user's usage environment, and shall bear no liability with regard to the preparation thereof.
  3. If a group or individual claims to have been inconvenienced or to have had their rights violated as a result of actions taken by the user through the Service, such claims must be resolved at the liability and expense of the user, and Redfox shall bear no liability whatsoever with regard to any such claims.
  4. If a user defames another person, infringes the right to privacy of another person, engages in action that violates the Copyright Act, or engages in any action that otherwise infringes the rights of another person through the Service, such matters must be resolved at the liability and expense of the user, and Redfox shall bear no liability whatsoever with regard to any such matters.
  1. Redfox may change or eliminate part or all of the Service without prior notice.
  2. Redfox makes no guarantee as to the accuracy of information obtained by the user through the Service.
  3. Redfox makes no guarantee that obstacles to the operation of the Service will not occur. Redfox shall bear no liability whatsoever for any damage resulting from faulty communication lines, computers, and other equipment due to system interruption, delay, cancellation, data loss, or unauthorized data access, or for other damage suffered by the user in relation to the Service.
  4. Regardless of its intent or negligence, Redfox shall bear no liability with regard to any damages resulting from the provision of the Service.
  5. No warranty is made as to the compatibility of the Service with the user's cellular phones, PHS handsets, or smartphones.
  1. Placing a load on the servers used to operate the Service that is heavier than that generated under normal use.
  2. Criminal actions and actions that promote crime.
  3. Illegal actions and actions that promote legal violations.
  4. Actions that result in or promote suicidal or self-injurious behavior.
  5. Actions constituting vandalism or actions taken in reprisal for vandalism.
  6. Annoying, harassing, or slandering other users.
  7. Using the Service with another person's identity or falsifying information.
  8. Infringing copyright, patent rights, or other intellectual property rights.
  9. Actions that provide advance notice of crime or provide instructions on how to commit crime, or actions that may encourage crime.
  10. Discriminatory expressions or actions based on race, ethnicity, beliefs, sex, social status, abode, physical characteristics, medical history, education, possessions, income, and/or other factors.
  11. Actions that are vulgar, harmful, rude, or otherwise ethically problematic. Disclosing information containing content that may cause offense to others. Disclosing information related to pornography, prostitution, or the adult entertainment business.
  12. Sharing user accounts. Owning more than one account per user, except in cases where specially permitted by Redfox.
  13. Using user names or nicknames that may cause offense or misunderstanding. Using user names or nicknames that are identical to or similar to the name, "Redfox," or the names of other people, well known companies, organizations, or product names.
  14. Stealing, collecting, accumulating, changing, or using personal information and/or points from other users. Illegally manipulating or changing your own personal information and/or number of points.
  15. Other actions determined by Redfox to interfere with the smooth operation of the Service.
  1. The user shall retain rights pertaining to information prepared by the user through use of the Service. However, this assumes that such information fulfills the requirements of related laws and regulations, and Redfox shall have no concern as to whether or not such requirements are actually fulfilled.
  1. Redfox may, at its own discretion, delete, change, or otherwise alter all or part of information created by the user.
  1. Registration for the Service shall be free.
  2. If a user wishes to use non-free services, they may do so by purchasing, via prescribed means, points used in the Service, in accordance with the terms and conditions of the TOU.
  3. Charges and fees related to the use of the Service shall be stipulated separately by Redfox.
  4. "Points" are a units used in the Service in place of the charges required for the use of non-free services and the purchase of non-free content. Users purchase points, and can use points they own themselves to use non-free services and purchase non-free content.
  5. Charges related to the purchase or exchange of points shall be borne by the user who whishes to make the purchase or exchange.
  6. Users may have a maximum of 100,000 points at any one time.
  7. Points shall be valid for 12 months from when the user last used or acquired them, and points that have exceeded this period shall expire.
  8. Redfox may, without prior notice, revise procedures related to usage charges and the purchase and exchange of points related to the Service.
  1. Users may sell, or offer for free, decks that they have created to other users of the Service by selecting "Publish" under "Status".
  2. When a deck is sold, prices that may be set for it are: Free, 50 points, 100 points, 150 points, 200 points, 300 points, 400 points, 500 points, 600 points, 700 points, 800 points, 900 points, 1,000 points, 1,500 points, 2,000 points, 3,000 points, 4,000 points, 5,000 points, or 10,000 points.
  3. When a deck is sold and is actually purchased by another user of the Service, a fee of thirty percent shall be deducted from the number of points the deck was sold for, and the remaining points shall be allocated to the selling user. For details on point allocation, see the iAnki points list.
  4. Decks described below cannot be sold.
    • Decks users have not made themselves.
    • Decks that infringe copyright.
    • Decks that contain no cards or that contain cards with no content.
    • Decks where actual content differs significantly from described content.
    • Decks that contain advertising.
    • Decks with content that promotes crime and similar behavior.
    • Decks that damage, insult, or otherwise harm the reputation of individuals or companies.
  5. When selling a deck, actions that constitute the following items are prohibited:
    • Continuously changing the price of a deck in a short period of time.
    • Continuously changing the contents of a deck within a short period of time.

  1. The laws of Japan shall be applied to the TOU.
  2. The Tokyo District Court shall serve as the court of first instance with exclusive jurisdiction over any and all disputes that may arise between the user and Redfox.
